LOS ANGELES - Paris Hilton was released from a Los Angeles County jail early Thursday because of an unspecified medical problem and will fulfill the remainder of her sentence for probation violation in home confinement, a sheriff's spokesman said.

The 26-year-old hotel heiress was sent home shortly after 2 a.m. wearing an electronic monitoring ankle bracelet, sheriff's spokesman Steve Whitmore said.

Hilton was sentenced to 45 days for violating her probation in a reckless driving case, but had been expected to serve 23 days in jail because of state rules allowing shorter sentences for good behavior.

She ended up spending three full days at the all-women's facility in Lynwood, but because she checked in late Sunday and left early Thursday, authorities credited her with five days of time served. She'll be confined to her Hollywood Hills home for 40 days.

"I can't specifically talk about the medical situation other than to say that yes, it played a part in this," Whitmore said.

Hutton didn't immediately return calls seeking comment Thursday. Nor did her publicist, Elliot Mintz.

Whitmore refused to answer questions from reporters when asked if the medical condition was physical or psychological. He said it was not a staph infection. The jail provided Hilton with a pamphlet on the skin infection when she checked in.

The conditions of Hilton's home confinement were not immediately disclosed. Whitmore referred all questions to the L.A. County Probation Department. Messages left for the person handling media calls weren't immediately returned.

Hilton had surrendered to authorities with little fanfare late Sunday after a surprise appearance at the MTV Movie Awards, where she worked the red carpet in a strapless designer gown.

"I am trying to be strong right now," she told reporters at the time. "I'm ready to face my sentence. Even though this is a really hard time, I have my family, my friends and my fans to support me, and that's really helpful."

Hilton was housed in the "special needs" unit of the 13-year-old jail, separate from most of its 2,200 inmates. The unit contains 12 two-person cells reserved for police officers, public officials, celebrities and other high-profile inmates. She didn't have a cellmate.

Hilton's lawyer, Richard A. Hutton, said Monday after his client's first night in jail that she was doing well under the circumstances.

"She's using this time to reflect on her life, to see what she can do to make the world better and hopefully, in my opinion, to change the attitudes that exist about her among many people," Hutton said after visiting Hilton.

When Hilton was sentenced May 4, Superior Court Judge Michael T. Sauer ruled she would not be allowed any work release, furloughs or use of an alternative jail or electronic monitoring in lieu of jail.

Whitmore said Thursday that Sauer "was consulted and he was advised."

Officers arrested Hilton in Hollywood on Sept. 7. In January, she pleaded no contest to the reckless-driving charge and was sentenced to 36 months' probation, alcohol education and $1,500 in fines.

She was pulled over by California Highway Patrol on Jan. 15. Officers informed Hilton she was driving on a suspended license and she signed a document acknowledging she was not to drive. She then was pulled over by sheriff's deputies on Feb. 27, at which time she was charged with violating probation.

Well, she's never appeared to be in the best health, it doesn't surprise me she'd get sick in jail. However, if I were sick in jail it'd be the infirmary for a while then back to my cell.

Instead she gets to go home and hang out at her mansion for a month. I'm not surprised in the least.

Yeah, I don't know...I've been hearing a lot about this today and a lot of people are assuming she got out because of who she is, but I doubt that was the main factor.
This happens all the time.
DH had a drunk driving charge back in 2004 and got another one right away. the kept him for a little more than 24 hrs and then let him go.
He ended up doing all kinds of community service instead of jail time. jails are overcrowded, people get let out all the time way before they are supposed to.
It's sick and it shouldn't be that way.

And if it was The Game or Snoop Dogg or something and that happened to them then they would be right in the infirmary. It is a catch 22 though, because she should go back to jail but at the same time she shouldnt.

i heard today on the morning show with mike and juliet that she might have to go back. but htey were talking about how if it was a normal person that they would have gotten just a fine, probation, or just a couple of days in jail. well thats all critter got so they're right. i wonder if they'll go back . . . . .

i was reading on perez hilton.com and basically according to his website there is a staph infection going around the jail and that is why she was let out. but they are also saying that she might be going back to jail. this really does not upset me just because there is so much corruption in american police forces that something like this really is minor. if there was all this media attention on cops when they beat people for no reason other than there skin color or the fact that in jamaica, ny they fired 50 times at an unarmed man and killed him on his wedding day. that is what should be in the headlines not paris hilton.

I do not feel sad for her.
Do you know how many times the average person drives drunk before they are caught? 60, at least.
Everyone on the road is put in harms way and she should get NO sympathy.
DH had two DUI's and believe me, he got NO sympathy from me.
It was- pay the consequences, quit drinking and get over it!

She had been arrested for DUI and never enrolled in the classes she was ordered to and she got caught driving on a suspended license and had two other traffic violations.

Poor white, rich Paris has to do her time.

I'm glad she went back. Guess that is kind of mean, but she is a example for the rest of the celebs that think they can get away with stuff. It's unfair.

i don't know. i think the idea of jail is a bunch of bs and doesn't do anybody much good so as to weather or not someone ought to use something i don't think should exist i'm ambivilant.

i do think it's incredibly sad that a person could come to adulthood so sheltered and shakeable that 45 days in a min security facility with no cellmate could cause a nervus breakdown. it's not as if she's worried she's lost her job and will be broke when she gets out or have her kids taken away. i mean, jail is (just going by what i hear from my friends who've been there) unplesant in the extreem but not really all that scary in the condtions she's being kept under (no cell mate not hard physical labor given special protection). how sad is it that she really probably is frightened to death of being perfectly safe around a bunch of other people who got DUI's etc and being givent he chance to **gasp** read a few good books. how do people get so screwed up?

im sorry..but someone with that amount of money could of easily taken a cab or hell a limo... dui's are big deals, and i believe that they deserve the full sentence... let out the petty crimes, dui's endanger everyone.

i agree with this 110% let someone else drive you, you can afford it and probably pay someone a salary to be on hand for this very reason.

i do have to say that i feel for paris in the sense that this girl seems like she is having a total identity breakdown right now, and those few days without people telling her she's great and reaffirming everything she has been fed her entire life has got to be shattering to her psyche. i doubt she's really been alone for any significant amount of her time ever in her life. i think her being in jail is the right thing, and i just hope she is a better person because of it, however many days from now they let her go. i really feel nothing more than pity for her.
