Harassment?

Harassment?

Okay, I have a friend who is in the midst of a nasty divorce.

Her soon to be ex is sending her threatening/harassing emails several times a day (4 emails just yesterday) saying shitty things, that he's going to kill her, that he cheated on her their entire marriage, etc. This has been happening for almost a year. He keeps getting new email addresses so she won't block all his. He's even called to say he was going to kill her.

What can she do legally? She lives in Idaho, he lives in California. I don't know if she can do anything about the phone call since there's no PROOF that he said that, but do the emails constitute harassment and threats?

Is it going to cost her to file paper work? What exactly can she do if the paerwork goes through and he continues to harass her?

Im not sure about laws and stuff but make sure she saves the emails! Does she have a lawyer? She should show those to a lawyer and see what they suggest. Also, im sure someone else here can help u out more then I can.

I dont know state Laws but there are laws in place I know set up here in canada, that if someone is sending you threatening emails you can charge them, I'm thinking that something can be done in the states too!

He can be charged with stalking (I think) harrassment, she can get a restraining order against him (she should absolutly get a restraining order against him).

YES! It's harassement at least. Save the emails! Print them out, and forward them to a trusted third party if possible.

Don't know about California, but in Maryland this is definite grounds for a restraining order, and a gal could file for emergency custody, etc.
