Hi, I am new, but I have a question first.

Hi, My friend is 17 and has a 10 month old daughter. She can not stand living with her parents, they always threaten to call the cops if she leaves because she is only 17. Is it true that you are legally emancipated once you have your own child? Or did I hear that wrong. If you can please direct me to some websites that would be great or some advice.

It depends on where you live. I know that in Minnesota, there is NO legal emancipation, however when you are 16, you can legally leave home.

I would maybe see if she could talk to a school councler about it, who would either know more about it or be able to find the legalities out easily.

I am sorry for your friend, that must be really frustrating.

Here is some info on emancipation for NY. It doesn't say anything about having a baby, but you might want to check it out.

i know in georgia, you can leave home but you cant be emancipated except by a court, however i believe a court would see that being emancipated would be in the best interest of this mom. but she can leave her home situation. she could always call juvanile court, they will tell her the laws in her state concerning that. but im pretty sure that she should be able to stay with a friend or someone at 17. meaning the parents cant call her a runaway.

I was arrested and taken into custody at 16 for running away. It was a horrible experience that I still haven't been able to really talk about. Your friend should be careful.

I found a website defining the statutes of emancipation in New york.
From what i understood a person is considered emancipated if he or she is 0ver 16 but under 18, lives away from his or her parents and recieves no benifits from them.

Also, if you go to yahoo and type "New york emancipation of minor laws" you will get many more sites.
I think since your friend is 17 she can get out of the house as long as her parents give her no support.

when i had samantha i was 17 and one of the docs that i had told me that i was adlut even thou i was not 18 yet but i am not sure if thats ture i did hear that thou and if she leaves the cops can not do any thing about it except report her a runaway and if well thats how it is here anyways.

In my experience, as long as she is a legal minor, her legal guardian can tell the cops to take her into custody.
